Janlea Patent Company Represented “A Type of Nozzle Structure Used in Tail Gas Treating Equipment of Internal Combustor Engine” Review and Succeeded

The applicant “Baitong Huanbao” filed an invention patent application named “A Type of Nozzle Structure Used in Tail Gas Treating Equipment of Internal Combustor Engine” to the State Intellectual Property Office on December 4th 2006. The application no. was 201110033557.1 and the date of publicizing was June 22nd 2011.

After thorough analysis, agent Xuemei Zhang argued that with the basis of changing the claims, the application could overcome the weaknesses it had in the rejection decision. After careful preparation, the applicant “Baitong Huanbao” filed the review request to the Patent Reexamination Board on July 26th 2013. He also changed term 1 of the claims.

The collegial panel posted the review notice on June 18th 2013. The review applicant submitted the opinions statement and changed the claims on July 3rd 2014, prescribing in term 1 of the claims that “the exit of the nozzle matches with the cone of deflector of the nozzle”.

After evaluation, the Patent Reexamination Board decided as follows: The technicians of this field had no intention to change valve head structure in the document for comparison and install the valve had on the outer surface of the end of the nozzle through fasteners. Therefore, the document for comparison failed to elucidate in terms of applying the differentiating technical characteristics to the closest current technologies to solve corresponding technical problems. Term 1 of the claims was in compliance with the innovation described in article 22 paragraph 3 of the Patent Law.

The application was a model example of invention patent application succeeding in review after rejection. In this case, Janlea’s patent agent, through analysis and study of the application, formulated the correct responsive strategies and methods, protecting the rights of the client of our patent company to the largest extent and receiving appreciation from the client.
