The invalidation declaration case involved the no. 200810146855.X invention patent, named “Insulated Equalizing Tube Used for EHV and UHV Transformer and Its Production Method”, which was granted by the State Intellectual Property Office on October 22nd 2010. It was applied on August 26th 2008 and involved the patent owner Changzhou Yingzhong Electric Co., Ltd.

The submission of this invalidation request was not represented by our company. We accepted the commission from the invalidation applicant Taizhou Weideman High Voltage Insulation Co., Ltd. midway to conduct the oral trialing. Since the debate in oral trialing can only be based on the original facts and reasons, the invalidation declaration asserted that the aforementioned patent was not in compliance with the novelty and innovation described in article 22 paragraph 2 and 3 of the Patent Law. 

During the trial, the two parties conducted thorough debating. 

The Patent Reexamination Board accepted some of the arguments of the invalidation declaration applicant and made the “Invalidation Declaration Request Evaluation Decision” on June 28th 2012. The Board announced that the certain requirements for the rights of the aforementioned patent were not in compliance with the novelty described in article 22 paragraph 2 of the Patent Law.
