On September 3, China's international brand festival activities continued in full swing. In order to improve the agency's professional quality and service level, promote the healthy and orderly development of trademark agency, trademark festival ran “the outstanding trademark agency case campaign of 2016-2017”. As one of the important activities of Trademark Festival, the case campaign held on September 3 in the afternoon in international conference hall of Guilin International Convention and Exhibition Center and announced the results of campaign.
The campaign of “2016-2017 excellent trademark agency case” run by the China Trademark Association received the campaign cases more than 100. According to polling of Review Committee composed of experts and scholars from courts, colleges and universities, and trademark administration departments, finally 21 cases comes standing out. Among them, the “QiXing trademark objection review administrative lawsuit” deputed by Janlea won the honor of “2016-2017 Excellent Agency Case”. Xujing, a senior intellectual property attorney of Janlea received the award on stage.
“QiXing” trademark objection review administrative lawsuit is a typical case of legal interest about protecting time-honored brand. Time-honored brands are generally featured with distinctive Chinese traditional cultural background and rich cultural heritage. It is urgent to deter the time-honored trademark rush registration especially in the pharmaceutical industry, in which sector the time-honored brands are far more than other industries, so that the time-honored brands will be protected from the source of intellectual property. The well-known trademark is a kind of legal concept of mark protection rather than an honor and a business promotion concept. QiXing case embodies that the well-known trademarks, as a special mark protection system, provide the strong legal support on protection and inheritance of time-honored brands.
It is three sequent times that CTF held the outstanding case selection. It is also the third time that Janlea IP Agent honored this award, except for the trademark revocation administrative proceeding of “BaoDao” and administrative litigation of invalidation of “Weibo” trademark.
