A patent litigation during the Spring Festival in 2011 still seems like fresh memory for Zhang Xuemei, the General Manager of Beijing Janlea Patent Agency Co., Ltd. (hereinafter referred to Beijing Janlea). On the eve of the Spring Festival this year, everyone was ready to enjoy their holidays. However, an urgent litigation case interrupted the plans they had: an entrepreneur from Jiangsu was prosecuted on the grounds that the his products infringed the patent right of the other. Zhang Xuemei recalled that, this entrepreneur was originally a development technician of a chemical engineering business in Jiangsu. Soon after he quitted his job and started his own business, assuming the technology he developed was advanced in comparison to that of the original business, he invested huge amount of money in its production. In fact, when he was investing to introduce relevant products, a friend of his did suggested to him that he should have found a patent agency and conducted an inquiry and analysis on related technologies if he would like to start a business with his own invention, so that the relevant products would not fall under the protection range of others’ patent rights. Hearing the kind reminder, the entrepreneur did not pay much attention and thought that his technology would not infringe the intellectual property rights of others. However, to his surprise, after the products of the company had been introduced, his old employer chose to file a lawsuit against him.
The agents from Beijing Janlea Patent Agency told the reporters that, through careful research and repeated comparisons between the entrepreneur’s patent and the involved patent, they found out that the technology he used was different from the involved patent. The differences could not only lower costs but also raise the yield. With these solid proofs, the case was eventually solved through mediation.

He also submitted a patent application. “Because the related technologies developed by this entrepreneur had certain competitiveness in the market and also because he submitted the patent application, the production value of his business rose continuously within one year of time, having a bright future for its development”, said Zhang Xuemei. In the end, with the patent application, the business of this entrepreneur was purchased by a local chemical engineering company.
