In December 2014, after 29 month, China International Economic and Trade Arbitration Commission made the final arbitration on “Wanglaoji” trademark licensing recordation contract dispute between Guangzhou Pharmaceutical and Hongdao Group according to the laws. The China International Economic and Trade Arbitration Commission refused the arbitration claim of Hongdao Group and arbitration claim of Guangzhou Pharmaceutical received complete support from the Commission. The case was a dispute caused by “Wanglaoji” trademark recordation contract of the licensing contract, after China International Economic and Trade Arbitration Commission processed the “Wanglaoji” trademark licensing contract dispute in 2012. Lawyer Zhang Hong and lawyer Xu Jin attended the planning of arbitration of this case and the complete arbitration procedure as the attorneys of Guangzhou Pharmaceutical. Through a difficult and time-consuming arbitration procedure, we finally obtained the complete victory in the “Wanglaoji” trademark licensing contract arbitration case.
China International Economic and Trade Arbitration Commission ruled as follows in the arbitration: Hongdao Group contended in this case that the Wanglaoji trademark licensing contract was not an independent contract but was part of the Wanglaoji Trademark Licensing Contract and the recordation contract as a supplementary agreement between Guangzhou Pharmaceutical and Hongdao Group. Under the circumstances that Wanglaoji Trademark Licensing Contract had expired and the related supplementary agreements were ruled as ineffective by China International Economic and Trade Arbitration Commission in the 2012 arbitration case, the Commission would not support Hongdao Group’s claim of Guangzhou Pharmaceutical following the recordation contract in this case.
Due to the influence of this case among the public and its legal applicability as a typical case, it was selected to the China Arbitration Top 10 Influential Arbitration Cases.
