Recently, Beijing No.1 Intermediate People’s Court closed the trial for the Zhejiang Yingbo Zhedong Brewery Co., Ltd.’s “K Figure” trademark administrative litigation. Zhejiang Yingbo Zhedong Brewery, represented by our firm received a ruling in favor.

The court, after the trial, ruled that the “K Figure” trademark applied by Shenzhen XX Brewery Co., Ltd. for registration constituted a similar trademark to the “K Fuigure” trademark previously registered by Zhejiang Yingbo Zhedong Brewery Co., Ltd.. The approval of Well-Known Trademark provided by Shenzhen XX Brewery was not sufficient to prove that the “K Figure” trademark registered later by Shenzhen XX Brewery would not be confused with the “K Figure” trademark registered beforehand by Zhejing Yingbo Zhedong Brewery. Therefore, Beijing No.1 People’s Court affirmed the opposition review adjudication of and refused the registration application of the no. 1951299 “K Figure” trademark.

The Trademark Review and Adjudication Board had already made adjudication for this case and approved the trademark in question for registration. Through the accusation we made to Beijing Higher Court, we had repealed the previous adjudication and the Board gave the review adjudication. The above was the first-instance ruling of court on the review adjudication.
