As per the Memorandum of Understanding for Remittance of (PCT) Fee have concluded between China National Intellectual Property Administration and World Intellectual Property Organization, China National Intellectual Property Administration will charge PCT application at the international phase by RMB that was published by World Intellectual Property Organization, since 1st December 2021, and will no longer use the Swiss franc standard for conversion.
It is reported that, as per the latest fee standard published by World Intellectual Property Organization in November 2021, China National Intellectual Property Administration published the standard of charging fee of PCT application at the international phase. According to the agreement, World Intellectual Property Organization publishes Renminbi standard for the international phase of PCT applications for the next year. In principle, it remains valid for one year. If the standard needs to be adjusted due to excessive exchange rate fluctuation, it will be announced separately.
According to information, the international application fee of PCT applications that are filed to China National Intellectual Property Administration, and the acceptance date on and after 1st December 2021, as well as the procedure fees requested by PCT international primary review which are accepted on and before 1st December 2021, apply to Renminbi standard announced by this notification. The acceptance date of PCT application and the request of initial review of PCT applications on and before 1st December 2021, the related fees shall be converted and collected in Swiss francs in according with existing method. Except for fees collected by the international bureau, the search fees charged by China National Intellectual Property Administration remain unchanged.
