Notification on Establishing Online Litigation and Mediation Docking Mechanism for IP Disputations that was jointly published by the Office of the Supreme People’s Court of the People’s Republic of China and the Office of China National Intellectual Property Administration, the notification aims to give full play to the importance of medication in solving IP disputations, and to set-up efficient and convenient online medication docking mechanism, further, to strengthen the protection on the IP right. 

The notification clearly shows to set-up “the general to general” online medication docking mechanism, The Supreme People’s Court and China National Intellectual Property Administration to promote the establishment of online litigation and mediation docking mechanism for IP disputes, to smooth online and offline docking channel for mediation and litigation.

Also, the China National Intellectual Property Administration will guide administrative departments at all levels to set up the coordination mechanism with the people’s court at corresponding levels, to guide China IP disputes mediation organizations and personnel to enter medication system, to perform full online medication, online confirmation of judicial application or docking of mediation, fully improve the quality and efficiency of disputes regarding IP rights. 

Moreover, the notification clarifies mediation organization and personnel to collect and manage information, to confirm specialized mediation organization and personnel, online docking procedure of legislation and medication strengthen online video mediation and establish informalization for the mediation.

Next, The Supreme People’s Court and China National Intellectual Property Administration will jointly establish work mechanism, will continuously promote docking work regarding the legislation and mediation of IPR disputes, actively perfect the work frame for the protection of IPR.
